OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE GREATER OF: (a) The amount you paid to Saheeb in the 12 months preceding the claim, or (b) OMR 100 (One Hundred Omani Rials). These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, our liability shall be limited to the maximum extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless Saheeb and its officers, directors, employees, agents, affiliates, and partners from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or relating to: • Your use of or access to our Services. • Your violation of these Terms. • Your violation of any applicable law or regulation. • Any content you submit, post, or transmit through our Services. • Your infringement of any third-party rights, including intellectual property rights. • Any dispute between you and any third party. Any dispute arising out of or relating to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts located in Muscat, Sultanate of Oman. You hereby: • Consent to the personal jurisdiction of such courts. • Waive any objection to venue in such courts. • Waive any claim that such courts constitute an inconvenient forum. Notwithstanding the foregoing, Saheeb may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute with Saheeb through informal negotiation. Arbitration: If informal resolution is unsuccessful, any dispute shall be resolved through binding arbitration administered under the rules of Oman Commercial Arbitration in Muscat. The arbitration shall be conducted in English (or Arabic upon mutual agreement). Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Small Claims: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

Saheeb shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control ("Force Majeure Events"). Force Majeure Events include but are not limited to: • Natural disasters (earthquakes, floods, storms, etc.) • Acts of war, terrorism, or civil unrest • Government actions, laws, or regulations • Epidemics, pandemics, or public health emergencies • Power outages or telecommunications failures • Cyberattacks or system failures beyond our control • Labor disputes or strikes If a Force Majeure Event continues for more than 60 days, either party may terminate these Terms without liability.

Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect. No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Saheeb. Entire Agreement: These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Saheeb regarding our Services. Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. Saheeb may assign these Terms without restriction.

We reserve the right to modify these Terms at any time at our sole discretion.
